Appeal an infringement
In the following circumstances, the corporation may consider withdrawing an infringement for a parking offence with valid proof and a witnessed Statutory Declaration provided within 28 days of the infringement notice.
- You had a medical emergency that prevented you from removing your vehicle or paying for parking. Documentation from a medical practitioner or hospital is required to support this claim.
- Your vehicle was broken down and you could not contact the corporation. You must supply a towing receipt or proof of repairs (e.g. a receipt for parts, an invoice from a mechanic, AANT call-out documentation, etc).
- Your vehicle was stolen. You need to give the corporation the promise number provided by the police when you reported the incident.
- You were detained by the police. Documentation from the police is required.
Appeals will not be considered if you received your infringement because:
- You forgot to commence the PayStay session.
- You forgot to purchase a parking session at the meter.
- You entered the incorrect number plate at the meter or in the PayStay app. As the driver, you must ensure you enter the correct vehicle details for your parking session.
- You selected the wrong Zone in the PayStay app. As the driver, you must ensure your parking session is for the Zone in which you've parked.
- You forgot your permit. If you don't have your permit, you must pay for parking via a meter or the PayStay app.
- You thought you were allowed to park there. Only authorised vehicles can park in taxi zones, reserved bays, disability bays and bus zones.
- You didn't see the sign. As the driver, you must look for parking signs to confirm you can park there.
- You assumed or had been misinformed by someone other than authorised Darwin Waterfront Corporation staff that parking rules were the same as those in the municipality of Darwin, which is separately managed by the City of Darwin council.
- Your appointment/meeting went over time.
- You lost track of time.
- You were only parked for a few minutes. You must have a valid parking session at all times.
- You parked facing the wrong direction. This is an offence under the Australian Road Rules.
- You did not park entirely within the designated parking bay, partly encroaching into a traffic lane or bike lane, preventing the safe movement of vehicles/pedestrians.
